EB-5 Visas to Live in the United States

EB-5 Visa Classification: USCIS administers the EB-5 Immigrant Investor Program, created by Congress in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors. The program was substantially reformed and reauthorized by the EB-5 Reform and Integrity Act of 2022 (RIA), which is currently authorized through fiscal year 2027. Investors may qualify for EB-5 classification either through a direct investment or by investing through a regional center designated by USCIS.

USCIS policy on EB-5 adjudications is contained in Volume 6, Part G of the USCIS Policy Manual.

All EB-5 investors must invest in a new commercial enterprise that will create or preserve full-time positions for at least 10 qualifying U.S. workers.

Capital Investment Requirements

Capital means cash, equipment, inventory, other tangible property, cash equivalents and indebtedness secured by assets owned by the immigrant investor, provided the investor is personally and primarily liable and that the assets of the new commercial enterprise upon which the petition is based are not used to secure any of the indebtedness. All capital is valued at fair-market value in United States dollars. Assets acquired, directly or indirectly, by unlawful means (such as criminal activities) shall not be considered capital for the purpose of section 203(b)(5) of the Act.

Note: The immigrant investor must establish that he or she is the legal owner of the capital invested. Capital can include the immigrant investor’s promise to pay (a promissory note) under certain circumstances. Under the current rules, the required minimum investments are:

Standard (Non-TEA). The minimum qualifying investment outside a Targeted Employment Area is $1,050,000.

Targeted Employment Area (High-Unemployment or Rural Area). The minimum qualifying investment either within a high-unemployment area or a rural area in the United States is $800,000.

These amounts took effect under the EB-5 Reform and Integrity Act of 2022 and are scheduled to be adjusted for inflation every five years, with the next review due in 2027. Rural TEA projects currently benefit from a reserved 20% annual visa set-aside and priority processing, which has meant meaningfully faster case timelines for many rural-area investors compared to standard filings.

This information is provided for general reference and is not legal or immigration advice. EB-5 investment amounts, visa set-asides and processing times change over time — please consult a licensed immigration attorney to confirm current requirements before making any investment decision.
